The High Administrative Court has upheld the Education Ministry’s decision to transfer a teacher, affirming that employee transfers fall within the employer’s administrative discretion when serving the public interest.
The court clarified that an employee does not possess a vested right to remain in a specific post, and that transfer decisions are lawful as long as they do not involve abuse of power, a job downgrade or financial loss.
The ruling came after the ministry transferred a teacher to another school following an internal investigation.
When she challenged the transfer, the Court of First Instance annulled the decision, prompting the ministry to appeal. The ministry argued that the transfer aimed to address staffing shortages and did not harm the teacher’s rights, reports our sister paper Akhbar Al Khaleej.
