A worker at a famous fish restaurant, who killed one of his co-workers by bashing his head with a brick, has lost his chance at a retrial after not attending his court hearings.
The High Criminal Court yesterday ruled to dismiss the objection that the 39-year-old Indian murderer had filed, thus upholding his 25-year prison sentence.
The man refused to be brought to court from prison, even after being granted a second chance to defend himself since he did not appear at his initial trial.
In June, the appellant was found guilty of premeditated murder when he killed his colleague Muhammad Yousaf Muhammad while the victim was in the middle of his afternoon prayers.
The Pakistani victim was prostrating on the prayer mat at their labour accommodation in A’ali when the accused repeatedly and violently struck his head with a 2.77kg brick, fracturing his skull and facial bones.
As a result of the bloody attack, the 25-year-old victim fell into a coma and died nine days later at the BDF Hospital.
When Mr Muhammad was brought to the hospital, he was found completely unresponsive when assessed by neurologists, and was put on a ventilator.
The victim’s status was rated the lowest possible score in the Glasgow Coma Scale, which is used to measure the level of a patient’s consciousness after a brain injury.
According to the autopsy, the battering pierced the membranes protecting the victim’s brain, shattering at least the middle layer of the skull.
“No surgical intervention could have improved the patient’s condition or prognosis. He was simply put on life support in the intensive care unit until his heart stopped,” read the autopsy.
The GDN earlier reported that the Indian killer refused to co-operate with detectives after his arrest.
According to the Public Prosecution, the man behaved ‘hysterically’ and declined to give his testimony, even going as far as taking off his sandal to throw at the prosecution interviewer.
