MANAMA: The Covid-19 pandemic has led to an increasing number of investors including the arbitration clause in contracts, the head of a Bahrain-based regional arbitration body has said.
Nasser Al Mogahwi, the acting secretary general of the Gulf Cooperation Council Commercial Arbitration Centre (GCCCAC) said this is due to the many advantages of arbitration, such as the speed of resolution, confidentiality and the laws that are applied during the process of resolving the disputes.
“This has coincided with increasing interest from lawyers, engineers and others in understanding the process of arbitration, from knowing how to draft an arbitration clause to mastering the mechanism of executing arbitral awards and avoiding annulments in legal and judicial bodies,” he added.
Responding to an increasing demand for arbitration seminars, the GCCCAC continues to hold training programmes towards developing arbitration professionals.
As a part of the process, the first distance learning programme started on August 24 and ends on October 7, while the second one will start on October 26 and end on December 9.
Mr Al Mogahwi said the GCCCAC is working to constantly improve its training materials and instruments and cited as an example the publication of a new book which is a primer for its training programmes.
The book, Arbitration in Theory and Practice According to Arbitration Laws in the GCC Countries, is authored by Dr Mahmood Omar, a professor of comparative law and the legal counsellor of King Abdulaziz University in Saudi Arabia.
He is a certified arbitrator in many arbitration centres locally and internationally and also a member of the Arab Lawyers Union.
The publication has been adopted by the GCCCAC as certified course material for the ‘Arbitrators’ Preparation Programmes’ as it includes both theoretical and practical explanations involving all aspects related to the arbitration procedures in the laws of the GCC countries.
The book is also considered a comparative study between the arbitration systems of the GCC countries in implementing arbitration procedures and the GCCCAC charter.
