A MAN jailed for five years for mugging a restaurant owner has lost his final appeal.
The 49-year-old Indian was found guilty of theft and assault by the High Criminal Court in July.
The court heard how the defendant and three others stole BD350 from the victim’s wallet after attacking him outside his restaurant in Hoora on March 15.
The 49-year-old Indian farmer was the only man implicated in the case as the others could not be identified.
The 64-year-old restaurateur, previously recounted the attack in court which erupted after the defendant allegedly refused to pay money for a chicken meal he had ordered.
The defendant then lodged appeals at the Supreme Criminal Appeals Court and the Cassation Court which were rejected.
“The defendant lost his appeal due to sufficient evidence against him,” read the final appeal ruling. “The victim was at his restaurant when the defendant approached him while being drunk.
“He ordered a chicken meal and refused to pay the restaurant owner. He then told his victim to give him BD50 instead.
“The defendant, along with others, then attacked the victim outside the restaurant and stole BD350.”
The defendant, however, claimed that he confronted the victim allegedly as he owed him BD150. The farmer will be deported after completing his sentence.
