The Commercial Court has ruled that it lacks jurisdiction to hear a lawsuit filed by a Bahraini film distribution company seeking $400,000 from a foreign cinematographic services firm. The court found no evidence that the contract was concluded or performed in Bahrain, noting that the defendant is based in a Gulf state and that the agreement concerned distribution rights to a foreign film with no connection to the kingdom.
The court also highlighted that the contracts explicitly assigned jurisdiction to the courts of another Arab state. The Court of Appeal upheld the decision, confirming that a bank transfer made to a bank in Bahrain did not establish sufficient legal grounds for Bahraini jurisdiction, reports our sister paper Akhbar Al Khaleej.
