THE 10th High Civil Court has ordered the Health Ministry and two doctors jointly to pay BD22,000 to a Bahraini and his wife who lost their twin babies due to a medical error committed by both doctors.
The doctors’ responsibility for the babies’ death was confirmed in a judgment which proved that the two children did not receive the necessary care due to the defendants’ negligence.
The judgment convicted the two defendants in a manner that obliges them to compensate the plaintiffs. The court also ordered the ministry to pay the amount jointly as the defendants work under its supervision.
The plaintiffs’ attorney, Reem Khalaf, said in her lawsuit that both defendants had mistakenly caused the death of the twin babies by neglecting to examine the newborns to verify their vital signs. The defendants’ mistake was proven in a criminal judgement, which caused material and moral damage to the plaintiffs, said the attorney, claiming BD30,000 in compensation.
The court convicted the defendants of negligence as the defendants’ responsibility for the death was established and the criminal verdict became conclusive.
Since the defendants work under the Health Ministry’s umbrella, they are all jointly responsible for compensating the plaintiffs, the court heard.
