A BUSINESSMAN has been cleared of embezzlement by the Lower Criminal Court.
The Pakistani, aged 37, was standing trial after a Filipino woman said that she gave an employee at the immigration consultancy company, which the defendant owns, BD250 in return for a job in Canada.
However, she said that she did not receive any offer at a hotel abroad and was allegedly not given her money back by the company.
“The defendant was found not guilty of the charges due to lack of evidence,” read the court ruling.
“The woman who filed a complaint against him had signed an agreement that the fees she paid his company in return for a job offer were non-refundable.”
Defence lawyer Manal Dahi said that her client was not inclined to return the BD250 fee paid to his company even if she was not accepted for the job.
“My client did not commit anything illegal,” she told judges.
“There is a written agreement between his company and the Filipino woman that states that she will not get the fees back even if she does not get the job.
“The money is not refundable.”
The businessman described why he was not at fault.
“I am the owner of the company and we have been operating since 2018,” he told prosecutors.
“We provide visas and job opportunities in Asian and European countries.
“We send their CVs but if there isn’t a job opportunity, the company clearly does not return the money back.”
