The Attorney General, Saad Al-Safran, issued Decision No. (107) of 2026, establishing the Prosecution of State Security, Terrorism, and Its Financing as part of efforts to modernise the criminal justice system and enhance the country's ability to combat crimes threatening national security.
According to a statement from the Public Prosecution, the new prosecution office will operate under the Attorney General's office. It will be composed of a director, a deputy director, and a sufficient number of prosecution members. It will have exclusive jurisdiction to investigate and prepare cases involving crimes that threaten the state's integrity, security, and stability.
The office's mandate covers crimes related to internal and external state security under Law No. (31) of 1970, as well as terrorism and terrorism financing offenses under Decree-Law No. (47) of 2026 and Law No. (106) of 2013.
Its jurisdiction also extends to offences under Decree Law No. (13) of 2026 concerning the protection of military interests, as well as international crimes including genocide, crimes against humanity, war crimes, and crimes of aggression under Decree-Law No. (156) of 2025 on combating international crimes.
The decision empowers the prosecution to review terrorism risk requests, issue opinions for the Attorney General, prepare specialised studies, and release awareness messages within its scope.
It also organises case registration and ensures the continuity of existing prosecutions unless otherwise directed.
This move strengthens Kuwait's institutional framework for addressing state security threats, terrorism, terrorism financing, international crimes, and the protection of military interests, in line with legislative developments and the need for efficient judicial processes.
