A reckless biker has escaped having to pay a five figure sum in compensation to a fellow motorcyclist he ploughed into because the injured man took too long to seek compensation.
The High Civil Appeals Court dismissed the claim as a result of the time delay as legal action must be taken within three years.
A 32-year-old Bahraini suffered serious injuries, including several bone fractures, after a double disaster on a bike parade in Karranah.
Firstly, an unlicensed 17-year-old relative ploughed into his bike knocking him to the floor. Seconds later a 24-year-old struck him on the highway.
Both men were later fined BD100 after being found guilty of driving recklessly by the Lower Criminal Court last year. The teenager was also fined BD500 for driving without a licence.
The victim then filed a compensation claim at the High Civil Court, which ordered the 24-year-old defendant to pay a total of BD67,000.
At the appeal hearing, defence lawyer Zahida Hamza, representing the 24-year-old defendant, said that her client was not responsible for the initial incident.
But the timing of the compensation claim proved more significant. A limitation period sets out a time limit as to when legal proceedings may be commenced by filing a claim.
The victim filed a case in April, 2020, while the incident happened in October, 2016.
