A 54-year-old man is on trial for allegedly breaking the shoulder of another man after shoving him to the ground in a road rage incident.
According to a medical report, the 56-year-old Bahraini victim was left with chronic pain even after his fractures healed, which a doctor evaluated as a ‘four per cent disability’.
The High Criminal Court heard that, during the traffic dispute, the victim told the suspect, “Old man, have you no shame? Why do you act like this?”, despite being two years older than him.
The defendant reportedly responded, “I’m an old man – as old as your father – yet you don’t respect my age,” shortly before the fight turned physical.
Although the defendant previously admitted to charges, he told the judges yesterday that he did not intend to hurt the other man, and had pushed him away to defend himself, claiming the victim was acting violently towards him.
Meanwhile, the injured Bahraini previously recounted the incident. “On a day in October, I was driving back home in the Qadam area, when a traffic dispute with the defendant broke out on a two-way local street,” he earlier testified.
“He was blocking the street with the position of his car. I stepped out and asked him to reverse a little so my pick-up could pass through, but the defendant refused to move.
“He came out of his car angrily, and pushed me in the chest once, causing me to fall.”
Even after recovering from the fracture and completing physiotherapy, the victim reportedly suffers from pain in his left shoulder joint, ‘especially when flexing and rotating his arm’, the medical report stated.
The defendant’s lawyer argued that while he did push the other man, it was not with the intention of harming or assaulting him.
“My client admitted to pushing the victim, in a moment of agitation, but that does not mean he admits to causing an injury. There is no criminal intent in this case,” read the defence memo.
The suspect previously told the Public Prosecution that the incident occurred around 7pm, when both vehicles were stuck on a narrow, one-lane street in Qadam.
“We were headed in opposite directions, so I chose to back up my car to let him pass, but was surprised when the man came my way, berating me and calling me an ‘old man’.
“He was pointing at me, saying I was at fault, and his hand even reached into my car’s open window, which made me quite afraid of being hit by him,” he claimed.
“So I got out of the car, and he pushed me, so I pushed him back. By then, many people were gathered around us to break up the fight, but I didn’t see what happened to him after I pushed him back.”
The judges set September 29 as the date for the verdict.
